Nodety Acceptable Use Policy
This document is incorporated into and subject to the Nodety Terms of Service at nodety.com/terms. Capitalised terms not defined here have the meaning given in the Terms of Service.
1. Scope
1.1 This Acceptable Use Policy applies to all Users of the Services. It is incorporated by reference into the Terms of Service. Breach of this Policy may constitute a Material Breach of the Terms of Service.
1.2 Scope Limitation. Users may not use the Application, Templates, Nodety Content, or Projects beyond the scope of their Plan or licence.
2. Prohibited Activities
2.1 Users may not:
- (a) make any false statements regarding their data;
- (b) depict any person shown in a Template or Nodety Content in a manner reasonably considered offensive, including in connection with: (i) pornography or adult entertainment; (ii) tobacco advertising; (iii) political endorsement; (iv) stigmatising depictions of illness or disability; or (v) criminal acts;
- (c) use the Application, Templates, Nodety Content, or Projects in a pornographic, racist, defamatory, dehumanising, or unlawful context;
- (d) use any content within the Services that violates youth protection laws or criminal laws;
- (e) use the Application in connection with incitement to violence, hatred, bullying, or threats;
- (f) redistribute, resell, or transfer Templates or Nodety Content separately from a finished Project;
- (g) infringe third-party intellectual property rights or engage in unfair competition;
- (h) use Templates or Nodety Content as or as part of a trademark, logo, or indication of origin;
- (i) falsely claim authorship of a Template, Nodety Content, or Project created by another;
- (j) remove proprietary notices from Templates, Nodety Content, or Projects;
- (k) distribute Templates, Nodety Content, or Projects in formats enabling extraction or peer-to-peer sharing;
- (l) use Templates, Nodety Content, or Projects to the extent they incorporate Templates or Nodety Content, for machine learning, AI training, or biometric identification;
- (m) use Templates or Nodety Content outside the Application except as incorporated into final outputs;
- (n) sell, license, or distribute Projects, exported files, production files (such as embroidery, knitting, or cutting data), or any other Application outputs as digital products, templates, stock assets, or similar offerings on any marketplace, template store, stock platform, or comparable service. For clarity, this does not prohibit the sale of physical end products (such as embroidered garments or printed merchandise) that incorporate Application outputs; or
- (o) use Templates or Nodety Content as the basis for creating reusable templates, components, or similar derivative assets for distribution to third parties, whether free or paid, including via Share Links or any other sharing mechanism.
2.2 Facilitation and Vicarious Liability. Users are prohibited from enabling, assisting, or encouraging any other person to engage in conduct that would violate the Terms of Service or this Policy. If a User permits another person to access the Services through the User's Account, or provides outputs, materials, or information to another person knowing or having reason to know that such person will use them in violation, the User shall be jointly and severally liable for any resulting breach as if the User had committed the violation directly.
3. Competition and Source Code Protection
3.1 Competition Restriction. Users may not use the Application, its outputs, or any Nodety Content, directly or indirectly, to develop, improve, train, benchmark, or operate any product, service, or offering that competes with Nodety or any of its features, whether for the User's own benefit or on behalf of a third party.
3.2 Reverse Engineering. Users may not reverse engineer, decompile, or attempt to derive the source code, algorithms, structure, or logic of the Application, including but not limited to using browser developer tools, network inspection tools, or any other means to access, view, copy, or extract client-side code, obfuscated code, shaders, or other Application components, except as permitted by mandatory law for interoperability purposes.
3.3 Unlimited Liability. Breach of the competition restriction or reverse engineering provisions constitutes a Material Breach for which the User shall be liable for all damages, including consequential damages, lost profits, and lost revenue, without limitation by any liability cap in the Terms of Service. This applies regardless of how the source code, algorithms, or proprietary information was obtained, including through browser developer tools, unauthorised access, or any other means. The exclusion from liability limitations in the Terms of Service applies.
3.4 Benchmarking. The User may not publish, disclose, or distribute to any third party any performance tests, benchmarks, comparative analyses, or similar evaluations of the Application without Nodety's prior written consent. This restriction does not prevent the User from conducting internal performance testing for the User's own operational purposes.
4. Physical Production Use
4.1 Testing Requirements. Before using Application outputs in production machinery (e.g., for knitting, embroidery, laser cutting, or printing), the User must test outputs for compatibility with their hardware and software. The User must: (a) conduct tests on the target machine before each production run; (b) repeat testing after changes in specifications or machinery; (c) conduct tests in safe, monitored conditions with experienced operators; (d) only proceed to production after successful, error-free testing; and (e) immediately stop and consult Nodety if errors occur. The User is responsible for monitoring production with appropriate care and bears costs arising from non-compliance with these obligations.
4.2 Production Liability. Nodety shall not be liable for any damage arising during production if: (a) the User failed to comply with the testing requirements above; (b) damage results from machine wear and tear; (c) damage arises during testing; (d) damage results from faulty machine configuration or maintenance; (e) the User used non-standard, experimental, or unproven parameter settings, design patterns, or production practices; or (f) the User failed to apply industry best practices for their specific production method — unless the User proves the damage is attributable solely to the Application and would have occurred despite full compliance with these terms and industry best practices.
4.3 Prohibited High-Risk Use. The User shall not use the Application or its outputs for activities where use or failure could lead to death, bodily injury, property damage, or environmental damage, including structural, load-bearing, military, critical infrastructure, medical, pharmaceutical, life-safety, or any other safety-critical or regulated-industry application. Nodety shall have no liability whatsoever for any claims, damages, or losses arising from such use, regardless of whether Nodety was aware of it.
5. Regulatory and Professional
5.1 User's Regulatory Compliance. The User is solely responsible for ensuring that their use of the Application and its outputs complies with all applicable laws, regulations, industry standards, and certification requirements in the User's industry and jurisdiction. This includes obtaining necessary regulatory approvals, conducting required testing, maintaining required records, and ensuring outputs meet applicable safety, quality, or performance standards. Nodety does not provide regulatory advice and makes no representation regarding compliance with any specific regulatory framework.
5.2 No Professional Advice. Any guidance, suggestions, or assistance provided by Nodety (whether through the Application, support channels, documentation, or otherwise) is for informational purposes only and does not constitute professional, legal, engineering, regulatory, or industry-specific advice. The User shall not rely on such guidance as a substitute for independent professional judgement. Nodety shall not be liable for any decisions made or actions taken in reliance on such guidance.
5.3 Configuration. The User observes the instructions provided by Nodety for the configuration and operation of the Application.
6. Defect Reporting and Cooperation
6.1 Defect Reporting. The User is obliged to report defects in the Services to Nodety immediately, consider Nodety's instructions for analysing the problem, and forward all information available that is necessary for remedying the defect.
6.2 Precautions. If and insofar as technically possible, the User shall take appropriate precautions if the Services do not work properly, in particular by means of daily data backups, fault diagnosis, and regular checks of the data processing results.
6.3 Cooperation Costs. The User shall bear all costs incurred by Nodety due to the fulfilment of the obligations to cooperate as well as additional costs incurred by Nodety due to the non-fulfilment of such obligations.
6.4 Legal Compliance. Users agree to comply with all applicable local, state, national, and foreign laws, treaties, regulations, and conventions in connection with their use of the Services, including without limitation those related to data privacy, international communications, and the exportation of technical or personal data. Users agree to notify Nodety immediately of any unauthorised use of any password or Account or any other known or suspected breach of security.
7. Enforcement
7.1 Content Removal. Nodety is entitled to irretrievably delete content and information that violates the Terms of Service, this Policy, or statutory provisions, or is otherwise offensive or inappropriate. Users have no claim to reinstatement of deleted content.
7.2 Sanctions. If Users violate the Terms of Service, this Policy, or any applicable statutory provision, or in the event of other good cause, Nodety is entitled, at its sole discretion, to: (a) modify or delete User content and information; (b) temporarily restrict or permanently block the use of the Services or the Account; or (c) terminate the contract without notice for good cause.
7.3 Immediate Action. Nodety may impose sanctions without prior notice and without consulting the Users, even against their express will. After imposing sanctions, Nodety will give Users the opportunity to comment and will re-examine the sanctions after receiving a counterstatement.
7.4 Final Ban. After a final ban, there is no entitlement to restoration of the banned Account. A User who has been blocked may not log in with another Account.
7.5 Suspension for Non-Payment. Nodety reserves the right to suspend access to the Services for any Account for which any payment is due but remains unpaid after notice of delinquency. Nodety shall not be liable for any suspension resulting from non-payment.
7.6 Suspension for Ongoing Harm. Nodety may, with reasonably contemporaneous notice, suspend access if Nodety reasonably concludes that the User's use is causing immediate and ongoing harm to Nodety or others. Nodety will use commercially reasonable efforts to resolve the issues causing the suspension.
