Nodety Configurator Publisher Terms
This document is incorporated into and subject to the Nodety Terms of Service at nodety.com/terms. Capitalised terms not defined here have the meaning given in the Terms of Service.
1. Scope and Definitions
1.1 These Configurator Publisher Terms apply when a User publishes a Configurator. By publishing a Configurator, the User ("Publishing User") accepts these terms.
1.2 In these terms:
- (a) "Configurator" means an interactive, end-user-facing interface created by publishing a Composer Project within the Application, exposing selected Project parameters and displaying rendered output.
- (b) "Publishing User" means the User who creates and publishes a Configurator.
- (c) "Configurator End-User" means any person who accesses and interacts with a published Configurator.
2. How the Configurator Works
2.1 The Application allows Users on eligible Plans to publish any Composer Project as a Configurator. The Publishing User defines which parameters are exposed and activates the Configurator via a toggle within the Application.
2.2 Nodety generates a unique URL through which Configurator End-Users can view the Project output, adjust exposed parameters, and save personalised configurations.
2.3 Nodety does not provide Configurator End-Users with functionality to edit, clone, or access the underlying Project.
3. End-User Relationship
3.1 Configurator End-Users are not required to be Users of the Services or to register with Nodety or accept the Terms of Service. A Configurator End-User who independently holds a Nodety Account remains subject to the Terms of Service in respect of their own use of the Services.
3.2 The relationship between the Publishing User and their Configurator End-Users is governed by the Publishing User's own terms and policies.
4. Publishing User's Obligations
The Publishing User is solely responsible for:
- (a) ensuring that appropriate terms of use and a privacy policy govern Configurator End-User access. Nodety provides default Configurator End-User Terms at nodety.com/legal/configurator-terms as a template; however, these are provided without warranty and the Publishing User is solely responsible for determining whether they are adequate for the Publishing User's jurisdiction, industry, and use case. Use of Nodety's default terms does not transfer any liability to Nodety;
- (b) ensuring that Configurator End-Users are informed about data collection and processing in compliance with applicable data protection laws;
- (c) all Configurator End-User activity, including use of personalised outputs;
- (d) ensuring that the Configurator and its content comply with applicable laws;
- (e) obtaining all necessary rights and licences for User Content included in the Configurator.
5. Terms Display
5.1 Each Configurator displays a link to Nodety's configurator end-user terms at nodety.com/legal/configurator-terms. The Publishing User must not remove, obscure, or interfere with this link.
5.2 The Publishing User may additionally display their own terms of use and privacy policy within the Configurator. In the event of conflict between Nodety's configurator end-user terms and the Publishing User's terms, Nodety's terms prevail with respect to Nodety's technology, intellectual property, and infrastructure.
6. Billing
6.1 Configurator usage is billed in accordance with the rates and fee structure published at nodety.com/pricing, which may include per-submission fees, per-configurator fees, or other charges.
6.2 The Publishing User is solely responsible for all costs arising from Configurator End-User activity. Nodety is not liable for Balance depletion or charges resulting from Configurator End-User usage.
7. Data
7.1 Personalised configurations created by Configurator End-Users are stored as Project data within the Publishing User's Account. The Publishing User owns and controls this data.
7.2 For data protection purposes, the Publishing User is the data controller for any personal data collected from Configurator End-Users. Nodety processes such data on the Publishing User's behalf in accordance with the Data Processing Agreement at nodety.com/legal/dpa.
8. Enforcement and Indemnification
8.1 Nodety reserves the right to block, restrict, or disable any Configurator or Configurator URL at any time if Nodety reasonably determines that the Configurator violates the Terms of Service, applicable law, or the Acceptable Use Policy, or to impose rate limits or usage restrictions on Configurator End-User access.
8.2 The Publishing User indemnifies Nodety against all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from the publication or operation of a Configurator, Configurator End-User activity, or the Publishing User's failure to maintain adequate terms of use or privacy policies for Configurator End-Users.
